Terms of Use

These Terms of Use (the “Terms”) set out the terms governing access to and use of the Brübla mobile application and related services (collectively, “Brübla” or the “Service”). You accept the Terms by confirming your acceptance in the application. The processing of personal data is described separately in the Privacy Policy.

1. Who provides Brübla

The Service is provided by Daler Alierov PR Beograd, a sole proprietor registered in the Republic of Serbia (“we”). Tax identification number (PIB): 114979611. Registration number (MB): 67999398. Registered address: Republic of Serbia, Belgrade, Čika Ljubina 12/3.

You enter into a contract with Daler Alierov PR Beograd. We are responsible for providing the Service and paid features under the Terms. For questions about the Service, contact us at support@brubla.app; for privacy questions, contact us at privacy@brubla.app.

The iOS application is distributed through the Apple App Store. Publisher information is shown on the application’s App Store page. The publisher must have the rights and authority required to distribute Brübla. Responsibility for providing the Service under the Terms remains with the sole proprietor identified above.

Apple processes in-app purchases under the applicable Apple terms and application distribution agreements. Apple does not provide the Brübla Service.

2. User eligibility and acceptance of the Terms

Brübla is intended for personal use by individuals aged 16 or older. By creating an account, you confirm that you are at least 16 years old and have the legal capacity required to enter into the Terms. If local law sets a higher age threshold or requires consent from a legal representative, you may use Brübla only if those requirements are met.

You accept the Terms when you register or when we ask you to accept a new version. You must confirm your acceptance in the application. We record the version, time, and action by which you confirmed acceptance. You cannot register without accepting the Terms. Your options if you disagree with later changes are described in Section 17.

The Privacy Policy is provided for your information. Reading it does not constitute consent to every form of personal data use. Where optional processing requires consent, we request it separately.

3. What Brübla is for

Brübla is a personal coffee journal. It lets you save information about cups and bags of coffee, brewing recipes and equipment, as well as ratings, tasting impressions, photographs, and related information. Feature availability may depend on the application version, device, country, and whether you have paid access.

Brübla is intended for personal informational use and does not provide medical, dietary, financial, or other professional advice. We use reasonable efforts to operate the Service. Unless we expressly agree otherwise in writing, no separate service level agreement applies.

4. Account and security

To use Brübla, you need an account and a valid email address. You must verify the address before uploading journal content. Your email address must remain current so that you can receive important notices about the Service.

5. Rights to your content and its processing

You retain the rights to notes, ratings, photographs, and other materials you submit to Brübla (“User Content”).

You grant us a limited, non-exclusive, worldwide licence to store, copy, transmit, resize, and process User Content. We may use it only to the extent necessary to provide, protect, and support the Service for you, including recognition at your request. Our service providers may process the content on our behalf only for these purposes and subject to the Privacy Policy.

The licence lasts only for as long as necessary for these purposes, including applicable deletion and lawful retention periods.

Accepting the Terms does not authorise us to sell User Content or disclose it to third parties for their own advertising or product development. It also does not authorise us to use the content to train general-purpose machine learning models or models shared across users. Service providers may process the content to operate Brübla in accordance with the Privacy Policy.

If we offer optional product analytics or personalisation within the application, you choose these separately. We will explain the data, processing purposes, and providers involved. The Terms do not replace consent to such processing and do not by themselves authorise future personalisation or model training. You may opt out or withdraw your choice without losing access to the basic journal or purchased features that do not depend on it.

Recognition may be inaccurate or incomplete, so you should check recognised information before using it. Saved results can be edited. This warning does not release us from our obligation to provide a paid feature in accordance with its description.

You may upload User Content only if you have the right to do so. You must not upload unlawful material, malicious code, material that infringes another person’s rights, or sensitive information that is not needed for the coffee journal.

6. Free and paid features

Digital features in the iOS application are purchased through Apple in-app purchases. Apple charges the payment method associated with your Apple Account and manages payment authorisation, currency conversion, tax display, and purchase confirmation. Brübla does not receive your full payment card or bank account details.

Paid access begins when Apple confirms a valid purchase and Brübla links it to your account. You must use the relevant Brübla and Apple accounts to make and restore a purchase.

Under Section 15, we may also provide preserved paid time or compensatory access. Brübla tracks these balances separately and does not count the same period twice. Time balances are not separate purchases, money, or credits that can be transferred to another person. Tracking them does not pause Apple charges.

6.1. Auto-renewing subscriptions

Brübla offers monthly and annual subscriptions. The annual subscription is paid in one payment for twelve months. Its price is calculated as ten monthly payments rather than twelve; the difference is the annual plan discount. Before payment is confirmed, you are shown the total charge, subscription period, actual annual price, and savings for your App Store region.

Monthly and annual subscriptions renew automatically: monthly subscriptions for another month and annual subscriptions for another year, unless you turn off renewal in Apple’s subscription settings. Apple manages the charge and displays the renewal date and price. The renewal is charged at that price.

Cancelling a subscription stops future renewals. Unless Apple approves a refund or applicable law requires otherwise, access continues until the end of the paid period. Deleting the Brübla application or your Brübla account does not cancel your Apple subscription.

If Apple provides a grace period for your subscription after a renewal payment issue, access to paid features continues until that period ends. The grace period does not apply to a failed initial purchase and does not replenish the free recognition allowance.

If payment has not been confirmed by then, paid features become unavailable unless you have another valid basis for access. Journal entries and photographs remain available to view and edit.

Paid access is restored when Apple confirms successful payment and an active subscription. Payment issues are managed in your Apple Account settings.

7. Restoring purchases

To restore a subscription, sign in to your Brübla account and select “Restore Purchases”. This uses the Apple Account with which the purchase was made. When Apple confirms an active subscription, Brübla restores access for the remaining term without charging you again. Restoration does not restart or extend the subscription term.

If you deleted your Brübla account and later created a new one, you can restore an active subscription to the new account through the same Apple verification. This does not restore deleted journal entries, photographs, or other account data. A subscription provides paid access to only one Brübla account at a time; when transferred, access under that subscription ends on the former account.

To transfer preserved paid time or compensatory access tracked separately by Brübla, contact support. We will verify that the purchase and both accounts belong to you and transfer the remaining balance without charging you again. The transfer does not apply to eligibility for the free recognition allowance and cannot be used to circumvent a valid active suspension or final termination of access. We prevent the same access entitlement from being duplicated during a transfer.

8. Cancelling a subscription, refunds, and revocation of access

Apple manages App Store payments, subscription cancellations, and refund requests. Manage subscriptions in your Apple Account settings and request a refund through Apple’s official process. If you need purchase information or help confirming that the Service was unavailable, contact support@brubla.app. We cannot directly cancel an Apple charge or guarantee Apple’s decision. Apple’s payment process does not deprive you of any legal right to bring a claim against the responsible party.

When Apple approves a refund and revokes the subscription access entitlement, Brübla verifies the revocation and disables new actions that require that entitlement. A refund request alone does not end access. Access under another active and verified entitlement remains available.

Journal entries, photographs, and previously recognised data are not deleted and remain available to view and edit. If Apple reverses a previously approved refund and the access entitlement becomes valid again, Brübla restores the relevant paid access for the remaining term.

The Terms do not limit any mandatory rights you may have under law to withdraw from the contract, receive a refund, require the Service to conform to applicable requirements, or exercise other consumer rights.

9. Account deletion and data export

You can request account deletion in the application or, if you cannot sign in, by emailing privacy@brubla.app. We may verify that the request came from you. Access to the account ends when deletion begins.

We delete journal entries, photographs, derived files, sessions, and related account data from active systems within 30 calendar days after receiving a valid request. The Privacy Policy separately identifies which necessary purchase and access-time balance records we retain on a lawful basis, how long we retain them, and when residual backups are deleted. Retaining those records does not mean that the deleted journal is retained.

You can request a free data export at support@brubla.app. We will provide a ZIP archive containing journal data in JSON and CSV formats and photographs that are still stored in your account. The export includes information about cups, coffee bags, recipes, equipment, ratings, notes, and saved recognition results. Deleted content cannot be recovered.

After verifying the request, we will provide the archive within 30 calendar days of receiving it, or sooner if required by law. The secure download link remains active for seven days. If you need an export before deleting your account, say so in the request. We will coordinate the steps and will not delay a valid deletion request without notice.

Account deletion is separate from Apple payments. Before deleting your account, cancel any active Apple subscription if you do not want it to renew. If you later create a new Brübla account, you can restore a still-active subscription without paying again under Section 7. Only paid access is restored, not deleted journal entries, photographs, or other data.

10. Rules of use

You must not misuse the Service, interfere with its security or operation, or access another person’s account or data. You must not reverse engineer the Service except where permitted by law, collect data, or automate access without permission. You must also not circumvent purchase verification, carry out fraudulent transactions, or use the Service for unlawful activity.

11. Third-party services and the App Store

Brübla uses service providers for data hosting, email delivery, diagnostics, optional analytics, and other operational functions described in the Privacy Policy. The availability of those providers may affect the Service.

The licence for the application downloaded from the App Store is governed by Apple’s Standard End User License Agreement. Under that agreement, the application provider, not Apple, is the licensor of a third-party application. These Terms supplement the licence with terms governing use of the Brübla Service, account, and subscription. The relevant Apple terms also apply to your Apple Account, App Store use, and payments. The Terms do not override Apple’s mandatory distribution terms or mandatory consumer protection guarantees. Direct questions about the Brübla Service to us.

12. Service availability, changes, and discontinuation

We may maintain and improve Brübla and make changes for security, legal compliance, or technical compatibility.

If a change materially reduces the capabilities of a paid feature, we generally provide at least 30 calendar days’ notice by email to the account and in the application. The notice explains the reason, timing, and available options. We preserve purchased features for the current paid period to the extent permitted by law and technically possible. Changes will not introduce a hidden numerical recognition limit for ordinary personal use.

If preserving a purchased feature is not possible, we explain the alternative and provide the remedies available under applicable law. Where necessary, a solution concerning an App Store purchase will be coordinated with Apple. You are not required to accept a replacement that the law allows you to refuse.

Urgent measures required by law or for security may take effect sooner. We provide as much advance notice as possible and explain the reason.

We provide at least 31 calendar days’ notice of a planned discontinuation of the Service by email to the account and in the application. We remove subscriptions from sale in advance to stop future renewals and comply with Apple’s requirements.

The 31-day notice does not shorten a longer paid subscription. We continue providing the Service until the end of the paid period. If that is not possible, we coordinate an appropriate solution with Apple and comply with applicable consumer protection law.

To determine the amount of service not provided, we take all unused paid access into account, including preserved paid time. We do not cancel these balances without notice and addressing the applicable remedy available to you.

We explain how to obtain purchase information and request a refund through Apple, but cannot promise automatic approval or a specific refund amount proportionate to the unused term. Free compensatory days are not a separate monetary purchase and do not replace mandatory legal claims arising from the original unavailability of the Service.

A discontinuation notice states the deadline and procedure for requesting an export. We fulfil requests submitted by that deadline before the Service stops so that you have a genuine opportunity to download the archive. If the law requires us to accept later requests, we take reasonable measures to preserve the ability to provide an export.

Exceptional legal circumstances, security threats, or infrastructure failures may require us to stop the Service sooner. In that case, we notify users as soon as possible and address their rights concerning paid services and data. Such a shutdown does not constitute a waiver of those rights by the user.

13. Intellectual property

Rights in Brübla’s software, design, text, branding, and documentation belong to us or our licensors. User Content and third-party materials are excluded.

Subject to the applicable application licence, you receive a limited, non-exclusive, non-transferable right to use the Service personally under the Terms. Suspension or termination of that right is governed by Section 15 and applicable law. These rules do not allow us to arbitrarily deprive you of active purchased features. Third-party materials are subject to their respective licences.

14. Warranties and liability

We provide Brübla with reasonable care and skill. Unless expressly agreed otherwise, we do not promise uninterrupted availability, error-free recognition, or a guaranteed service level. These qualifications do not reduce the paid features we have promised or override applicable conformity requirements for digital services or mandatory consumer remedies.

We recommend keeping a separate copy of information that is important to you. This recommendation does not release us from liability for failing to meet our own obligations.

Each party’s liability is determined by applicable law. The Terms do not establish a fixed monetary cap on liability or exclude liability that cannot legally be excluded, including liability for intentional misconduct. All mandatory consumer remedies remain available.

The free extension of access under Section 15 is an additional measure. It does not replace a legal right to a refund or compensation for loss.

15. Suspension and termination of access

We may restrict or suspend access where reasonably necessary to prevent fraud, unlawful activity, material breaches, security threats, or to comply with legal requirements.

Before restricting access for a breach of the Terms, we send a warning to the account email address, explain the breach, and allow seven calendar days after the warning to remedy it. We may act immediately in cases of fraud, a security threat, or where required to comply with the law without delay. In that case, we explain the decision as soon as the law permits.

You may appeal a decision at support@brubla.app. A member of the Brübla team will review the appeal manually and report the outcome by email within seven calendar days after receiving it. If the suspension remains in place, we review whether it is still necessary at least once every 30 calendar days and explain why it continues.

During a suspension, we generally preserve read-only access to the existing journal where safe to do so. If access to the account itself creates the risk, you may still request an export or deletion through support after verifying account ownership. Any restriction on these options must be necessary and have a lawful basis. Deletion and export are governed by Section 9.

If we restricted access in error, we provide compensatory access to paid features free of charge. Its duration equals the paid subscription time during which our error prevented you from using the Service. We record the extension as soon as the error is confirmed and access is restored.

This voluntary compensation is provided as access time and does not involve a cash payment. Mandatory consumer rights and the ability to request a refund through Apple remain available.

During a justified suspension, we preserve the unused paid time remaining when the suspension begins. If additional subscription periods are paid during the suspension, we add them to the preserved balance once Apple confirms payment and the funds have not been refunded. The free recognition allowance and unpaid grace-period time do not create a paid balance.

In the suspension notice, we ask you to turn off Apple automatic renewal and provide instructions. If we detect new charges, we repeat the recommendation. Neither a suspension nor Brübla’s preservation of access time pauses or cancels Apple charges.

Once the suspension is lifted, the preserved balance and compensatory time are available to the same user. If part of the preserved time is already covered by the remaining paid Apple period, it is counted within that period and not added again. Only the uncovered portion of preserved time and the separate compensatory extension are used after the current paid Apple access ends.

While the Service remains operational, balances are not cancelled without notice. To avoid further charges, automatic renewal must be turned off through Apple.

We do not compensate the same period twice: preserved time and compensation for the same unavailability are calculated together. After a refund is confirmed, the corresponding periods are deducted from the paid balance. Any other active access remains available.

If a serious unremedied breach provides grounds to terminate access permanently after the applicable warning and appeal procedures, we do not confiscate unused paid time as a penalty.

Within seven calendar days after the final decision, we state the recorded balance, provide instructions for requesting a refund through Apple, and assist with information about the purchase and service not provided. We cooperate with Apple to find an available solution but do not guarantee a particular refund outcome. Mandatory monetary and other remedies remain available even if Apple’s process does not satisfy the claim.

Deleting or replacing an account does not circumvent a justified suspension. Once the restriction is resolved, the verified owner may transfer the Brübla-tracked time balance under Section 7. Terminating access or deleting the account does not by itself cancel the Apple subscription.

16. Governing law and disputes

The Terms are governed by the laws of the Republic of Serbia. This does not affect mandatory guarantees provided by the laws of your country of habitual residence or other applicable law.

The courts of Belgrade, Serbia, may hear disputes where they have lawful jurisdiction. This provision does not establish exclusive jurisdiction: you retain the right to apply to a court provided for by mandatory consumer protection rules or to use an available consumer dispute resolution procedure.

Complaints may be sent to support@brubla.app or to our registered address. We acknowledge and consider them within the time limits set by applicable consumer protection law. Attempting to resolve a complaint with us does not prevent you from using lawful remedies and does not constitute an agreement to mandatory arbitration.

17. Changes to the Terms

We may update the Terms for legal or security reasons or to organise the operation of the Service. We provide at least 30 calendar days’ notice of material changes by email to the account and in the application. The notice describes the changes and their effective date and, where necessary, asks you to accept the new version.

Urgent changes required by law or for security may take effect sooner. We explain the reason and provide as much advance notice as possible.

If you disagree with the changes, you may turn off Apple automatic renewal and stop using the Service. The previous terms and purchased features remain in place until the end of the current paid period to the extent permitted by law and technically possible. If they cannot be preserved, we explain why and provide the remedy required by law. Where necessary, a solution concerning an App Store purchase will be coordinated with Apple.

Rights to export and delete data remain available. Continuing to use the Service does not by itself constitute consent to a new optional data-processing purpose. We retain information about the accepted version and the action by which it was accepted and do not retroactively revoke purchased rights.
